UK Property - Land Registry

When researching the ownership of a UK Property, Properties in England & Wales can be accessed at the Land Registry, with different sites covering Scotland and Northern Ireland, where there are also different laws & terms regarding property ownership, and there are different charges for accessing those details.

So, as an example, using the known address of the former Prime Minister Liz Truss, of 52 Greenwich South Street, Greenwich, London, SE10 8UN, there are a number of Land Registry sites which can used. Firstly at the Land Registry, for free, you can search via a post code, to see any sales registered against a property since 1995.

The next, is a mapping search service offered by the Land Registry, which is quite useful, especially for isolated properties, or for when you have identified a property or an area of land but do not know the correct address etc. On this Mapping Search Site, you can search via a post code to identify linked properties, or use the map to zoom into an area, until you can identify the property or area you are interested in, which you can then click-on. This will display the map coordinates, and below you should select Confirm, which will open a new screen, titled Confirm Your Search Area. This new screen shows the area selected, with a blue circle, which can be made smaller or larger, to cover more or less properties. Once you have adjusted this, select Yes for Is The Land Or Property Included In The Radius Area, and it will open a new screen with any properties registered within that area, with links to access and purchase the ownership details.

Then, most importantly, to see who actually owns a Property, which can be accessed from the Land Registry, where you search for a Property, to obtain a Title Register, which shows who owns the Property, or the Title Plan, which shows you the outline of the Land covered by the Title, both of which are now £7. If you do not understand the terms Freehold or Leasehold, then you can read about them to help you, but it helps to use your own life experiences. If you need to know who previously owned a Property, than you can also obtain copies of the Historic Title Register for a Property from the Land Registry.

The Title Register shows who owns the property, when they bought it, how much was paid for it and if there are any Mortgages registered against it. It has also been noticed that many recent purchases have also shown the owners email address. Additionally it usually gives the previous owners details, whom the Property was bought from. There are other details which may also be shown, which may be useful to know, which includes;

Leasehold Flats - the Title Register will list which Floor a Leasehold Flat is on and if there is a linked Garage
Charging Orders - when the Registered Owner of a property has a County Court Judgment issued against them, the Creditor can apply for a Charging Order to be issued by a Court, which secures the Debt against a Property, allowing them to claim the funds from the sale of the Property if the Debt hasn't been repaid. The Charge usually shows the details of the linked County Court Judgment and the Lawyers dealing with the matter for the Creditor
Bankruptcy Notice / Bankruptcy Restriction - when a Bankruptcy Petition is lodged against an individual, the Court notifies the Land Charges department at the Land Registry, who search their records for any Property / Land owned by the Debtor, and if they do, a Bankruptcy Notice is registered against the Property Title, which will help inform any potential buyers that the person involved may be affected by a Bankruptcy Order, and that they might need to deal with a Trustee
Matrimonial Home Rights Notice / Home Rights Notice - these are used to protect a Spouse's right of occupation in a Property, even if they are not the legal owner, and are designed to help protect them from eviction and to protect them from the Property being sold without their consent
Legal Aid Agency Charge - in the context of Legal Aid, a Statutory Charge can be placed on a property to secure repayment of legal aid costs. This Charge is similar to a Mortgage and is registered with the Land Registry, essentially acting as a Secured Loan, allowing the Legal Aid Agency (LAA) to recover the costs if the individual keeps or gains property or money from the legal case
